Data protection is very important to us, and we are committed to protecting and properly using personal information in accordance with the SDPA (Swiss Data Protection Act) and the GDPR (General Data Protection Regulation of the European Union). This Privacy Policy explains how personal data is collected and used and outlines the rights and choices available in relation to this data.

 

Scope of application


These provisions apply between B3 digital AG, Ilgenstrasse 7, CH-9200 Gossau SG (provider), and the customer and their users regarding the use of the “buildagil” collaboration platform. The customer is the contractual partner of the provider. Users are the persons whom the customer authorises to use the “buildagil” collaboration platform by registering them.

Processing of personal information


Users’ personal and project-related data is processed for the following purposes, to which the customer and its users consent through their use of “buildagil”, insofar as this is necessary:
- To ensure project-related cooperation
- To ensure user-friendly and effective service
- For the maintenance and development of the user interface
- For support purposes
- To prevent the unauthorised use of services

- To validate the customer and its users
- For the fulfilment of contractual obligations towards the customer
- For invoicing the customer

Personal information is deleted as soon as it is no longer required for the purpose for which it was collected. Legal regulations, in particular the retention regulations on business relationships, may oblige the provider to retain personal information for longer. After ten years have elapsed since the purpose for which the personal information was collected ceased to exist, the personal information will be deleted. Personal information processed in conjunction with existing projects will be deleted no later than ten years after the end of the project.​

 

Rights


Users who are natural persons and about whom the provider processes personal information have the following rights:

- To obtain information about the processing of their personal information

- To correct incorrect personal information

- To request that personal information be deleted/anonymised

- To request that the processing of personal information be restricted if the customer simultaneously asserts other rights to which it is entitled under data protection law

- To request the transfer of personal information

- To withdraw their consent to the processing of personal information

The right to erasure is restricted in relation to project-related data and mandatory statutory data retention provisions, which prevent the provider from deleting the requested personal information.

The lawful exercise of one of the above-mentioned rights may result in the provider having to cease providing the service to the user exercising the right in cases such as when the services can no longer be provided as a result of revoked consent to the processing of personal information because the provider has no other justification for processing this data. Customers whose users exercise their rights in a way that requires the provider to discontinue the service for that user are not entitled to a refund for services already paid.


 

Additional provisions


The following provisions also apply: the Microsoft Privacy Policy at https://privacy.microsoft.com/privacystatement and the General Terms and Conditions of Use of “buildagil” at https://www.buildagil.com/legal/terms.

Should individual provisions of this Privacy Policy be invalid, void or incorrect, this shall not affect the remaining provisions. The resulting gap shall be filled, in good faith, with a provision that is permissible and that comes as close as possible to the original intent.

 

Amendments to this information


​The provider may amend the content of this Privacy Policy at any time. The updated Privacy Policy shall be deemed to have been accepted by the customer and its users upon corresponding publication and use of “buildagil”.
